This document establishes the terms and conditions for using the website www.bercov.ro and the applications operated by Bercov Media International SRL, including the SuperSimplu.ro platform and the internal tool Social Media Gateway. By accessing and using the website, you confirm that you have read, understood, and fully accepted these Terms and Conditions.

1. GENERAL PROVISIONS

1.1. Acceptance of Terms This document establishes the rules for the operation and use of the website www.bercov.ro and the products operated by Bercov Media International SRL. Any person who accesses or uses our website or applications confirms that they have read, understood, and accept these Terms and Conditions.

1.2. Intellectual Property and Use Restrictions Content published on the website, including texts, images, video materials, graphic elements, structure, databases, names, and logos, are protected by copyright and intellectual property legislation.

The following are prohibited:

• copying, distributing, modifying, reproducing, or publishing content without the written consent of the Company;
• automated data collection (scraping, crawling, unauthorized indexing, etc.);
• using the name, logo, or visual identity without the express prior permission of the Company.

1.3. Technical Operation Proper use requires an internet-connected device and a modern browser with JavaScript and cookies enabled. The Company makes every effort to ensure continuous operation but reserves the right to schedule technical maintenance breaks.

1.4. Privacy and Security By using the website and our applications, the user accepts the practices described in the Privacy Policy available on the website.

2. PRODUCTS AND SERVICES OPERATED BY BERCOV MEDIA INTERNATIONAL SRL

2.1. SuperSimplu.ro SuperSimplu is an online platform that facilitates collaborations between companies and content creators. The specific Terms and Conditions of the SuperSimplu platform are available at www.supersimplu.ro/terms-and-conditions.

2.2. Social Media Gateway Social Media Gateway is an internal business tool that allows the authorized team of Bercov Media International SRL to simultaneously publish video content on TikTok, Instagram, YouTube, and Facebook.

The application is not available to the general public and is intended exclusively for authorized employees and collaborators of the Company.

3. USER ACCOUNT

3.1. Account Creation Certain sections of the website may require the creation of a user account by completing the registration form with a valid e-mail address and password.

3.2. Eligibility Any natural person at least 18 years of age with full legal capacity, or a legally represented legal entity, may become a user.

3.3. Account Security The user must keep their authentication credentials confidential. Any unauthorized access must be reported immediately to contact@supersimplu.ro. The Company is not responsible for losses caused by unauthorized use of the account due to the user's negligence.

3.4. Account Deletion The user may request account deletion by e-mail at contact@supersimplu.ro.

APPS

4. SOCIAL MEDIA GATEWAY 

4.1. Restricted Access Access to Social Media Gateway is permitted exclusively to authorized employees and collaborators of Bercov Media International SRL. Unauthorized use is strictly prohibited and may result in disciplinary and/or legal liability.

4.2. Permitted Use The application may be used exclusively for:

• publishing video content on the Company's official accounts;
• managing and scheduling posts on connected platforms;
• monitoring the status of published posts.

4.3. Connected Platforms Social Media Gateway connects to the following third-party platforms via official API:

• TikTok (via TikTok Content Posting API)
• Instagram (via Meta Graph API)
• YouTube (via YouTube Data API)
• Facebook (via Meta Graph API)

Use of each platform is also governed by their own terms and conditions.

4.4. Content Responsibility Employees and collaborators using Social Media Gateway are responsible for the content they publish. Publishing the following materials is prohibited:

• illegal content or content that infringes copyright;
• discriminatory, offensive, or content contrary to the values of Bercov Media International SRL;
• content not authorized by the management of Bercov Media International SRL.

4.5. Confidentiality and Security Access tokens and credentials for connected platforms are confidential and may not be shared or used outside the application. Any security incident must be reported immediately to contact@supersimplu.ro.

4.6. Availability The Company makes every effort to ensure the continuous operation of the application, but does not guarantee uninterrupted availability, especially in the event of interruptions caused by connected third-party platforms.

4.7. LIMITATION OF LIABILITY

The Company cannot guarantee the continuous, error-free operation of the website or its applications. Interruptions, technical errors, or malfunctions beyond its control may occur, including those caused by connected third-party platforms.

The Company is not responsible for:

• interruptions to TikTok, Instagram, YouTube, or Facebook services;
• data loss caused by errors of third-party platforms;
• damages resulting from unauthorized use of the applications.

4.8. COMPLAINTS AND SUPPORT

Any complaint may be submitted to contact@bercov.ro. We will respond within 30 days of receiving the complaint.

4.9. INTELLECTUAL PROPERTY

All visual, textual, and technical elements of the website and applications (logo, name, design, structure, source code, images, texts, etc.) are the exclusive property of BERCOV MEDIA INTERNATIONAL SRL and are protected by Romanian and European copyright legislation.

Copying, republishing, modifying, distributing, or using any part of the content without the written consent of the Company is strictly prohibited.

4.9.1 COOKIES AND SIMILAR TECHNOLOGIES

 FINAL PROVISIONS

4.9.2. Applicable Law and Dispute Resolution This document is governed by Romanian law. Any disputes shall be resolved amicably, and in the absence of an agreement, jurisdiction lies with the courts of Bucharest.

4.9.3.Right to Modify The Company reserves the right to modify this document at any time, for justified reasons, such as:

• improving the safety and protection of users;
• optimizing the functioning of products and introducing new features;
• changes in applicable legislation or legal requirements imposed by authorities.

4.9.4. User Notification Any changes will be communicated by publishing the new version on www.bercov.ro. Changes take effect 15 days after publication.

4.9.5. Minors Our website and applications are not intended for persons under the age of 18.
